But right now is a very precarious time for Nintendo, were you aware that the previous CEO of the corporation Hiroshi Yamauchi, who had been CEO of the corporation since 1949, recently passed away, that he was the one who’s vision steered Nintendo into the gaming market in the first place, that revitalized a crashed video game industry back in the 1980s, and that because of certain customs in Japanese society their is a waiting period after a person’s death before talks can even begin concerning Yamauchi-sama’s sizable shares in the company which have passed on to his family, and what his family plans to do with them. Nintendo is a very old corporation that is currently in a time of great transition, during a very unstable period in the video game market. People who ask why Nintendo can’t go back to doing things the way they did in the 80s and 90s don’t realize the guy who was behind all that is gone, and now Nintendo has to figure out not only how to move forward with the guy who was behind the start of Nintendo as a video gaming company in the first place gone, but also the guy who created most of their iconic IPs, Shigeru Miyamoto, who was one of the primary minds behind all the Nintendo games we grew up with and which Nintendo as a gaming company was founded on, close to retirement. The video game industry is teetering on the edge of a second collapse, except this time the guy who revitalized it the last time isn’t around to do it again. Petri Batman Arkham Asylum was great. Doesn’t really feel like a superhero game. City and especially origins were not that great. Graeme Lynch It was Nintendo that refunded the few individuals that bought the season pass. I would theorise that Nintendo agreed with WB that if sales were low they would take the fall financially. As if you look at from a legal standpoint WB would be in breech of consumer contracts so it stands to reason that an agreement was made before this to let WB off the hook if the game sold poorly. A note to third party developers/publishers who think it’s ok to renege on delivering future content to customers who paid for it, just because you don’t think they constitute enough people to honor an agreement with…. be very careful in your business practices, or you may find yourself developing a tarnished reputation like Electronic Arts, and a nasty case of bankruptcy like Atari. It makes sense. If such an agreement were not in place then consumers and Nintendo could quite easily sue WB for breech of contract. Shy Guy It doesn’t have anything to do with “covering costs”, it’s about a company selling a product with the promise of future content if the customer pays X amount more, then the company later turning around and going back on that agreement with the customer who already paid for it, just because in this case the company thought their weren’t enough customers that they should bother to honor their agreement. Of course if the people who bought this season pass thing were provided a bunch of small text to read before paying for it that said Warner Brothers could do this, well than that’s that, it’s still pretty crappy business though and the kind of practices that lose a company customers.
